Child Support

 

Child support is a legal obligation that requires parents to provide financial support for their children, regardless of their marital status or custody arrangement. Child support is intended to cover the basic needs of the children, such as food, clothing, shelter, education, and health care. Child support is determined by various factors, such as the income of the parents, the number of children, the expenses of the children, and the time spent with the children.

In Nevada, child support is calculated using a formula that is based on a percentage of the non-custodial parent’s gross monthly income. The percentage varies depending on the number of children, as follows:

  • 18% for one child
  • 25% for two children
  • 29% for three children
  • 31% for four children
  • An additional 2% for each additional child

However, the formula is not absolute, and the court can deviate from it if it finds that it would be unjust or inappropriate to apply it. The court can consider various factors, such as:

  • The cost of health insurance for the children
  • The cost of child care for the children
  • The cost of education for the children
  • The special needs of the children
  • The relative income of both parents
  • The ability of both parents to pay
  • The benefits that the children receive from other sources, such as Social Security or disability
  • The best interests of the children
