Custody

Custody is a legal term that refers to the rights and responsibilities of parents regarding their children. Custody can be divided into two types: physical custody and legal custody. Physical custody determines where the children live and who takes care of their daily needs. Legal custody determines who makes major decisions for the children, such as education, health care, religion, and extracurricular activities. Custody can be shared or sole, depending on the best interests of the children and the agreement of the parents. When custody is shared, it can either be joint custody or primary custody to one parent, depending on the circumstances and the best interest of the child or children.

At Pearson Law, we understand that custody issues are among the most sensitive and important matters in family law. We know that your children are your top priority, and that you want to protect their well-being and happiness. We also know that every family is different, and that there is no one-size-fits-all solution for custody arrangements. That is why we offer a range of services and options to help you with your custody case, such as:

  • Negotiation: This is when the parents work together to reach a mutually acceptable custody agreement, without involving the court. This can be a faster and cheaper way to resolve custody issues, as it avoids litigation and court fees. It can also be a more cooperative and respectful way to maintain a positive relationship with the other parent and the children. We can help you communicate and negotiate with the other parent, and draft and review the custody agreement.
  • Mediation: This is when the parents use a neutral third party, called a mediator, to help them reach a custody agreement. The mediator does not make decisions for the parents, but rather assists them in finding common ground and resolving conflicts. This can be a more flexible and confidential way to resolve custody issues, as it allows the parents to control the outcome and the pace of the process. We can help you prepare for and participate in mediation, and advise you on the legal implications of the agreement.
  • Litigation: This is when the parents cannot agree on custody issues, and need the court to decide for them. This can be a longer and more expensive process, as it involves discovery, motions, hearings, and trials. It can also be a more adversarial and stressful way to deal with the other parent and the children. We can help you gather and present evidence, argue your case, and challenge the other party’s claims.
  • Modification: This is when the parents need to change or update their existing custody order, due to a change in circumstances, such as relocation, remarriage, or child’s preference. This can be done by agreement or by court order, depending on the nature and extent of the change. We can help you evaluate your situation and options, and file the necessary paperwork with the court.
  • Enforcement: This is when the parents need to ensure that the other parent complies with the terms of the custody order, such as visitation, support, or decision-making. This can be done by negotiation, mediation, or court intervention, depending on the severity and frequency of the violation. We can help you monitor and document the other parent’s behavior, and take the appropriate action to enforce the order.

No matter what type of custody service you need, we will be with you every step of the way, providing you with personalized and professional service. We will listen to your concerns and goals and provide you with honest and realistic advice. We will work with you to develop a strategy that suits your unique situation and needs.
